Dear Sir or Madam,

Our clients' privacy is extremely important, and we want you to feel comfortable regarding the security of your personal data.

Pursuant to Article 13(1) and (2) of the Regulation of the European Parliament and of the Council (EU) 2016/679 of April 27, 2016, on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) (OJ EU L 2016.119.1) (hereinafter referred to as the „GDPR”), I inform you that:

 

The administrator of your personal data is STALKO spółka z ograniczoną odpowiedzialnością sp.k., ul. Solec 24/253, 00-403 Warszawa, NIP: 9482603545, REGON: 361379132, KRS: 0000836475.

Your personal data is processed in accordance with the Regulation and Polish law for the purpose of:

  • execution of a potential agreement (legal basis: Article 6(1)(b) of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation), hereinafter referred to as the „GDPR”);
  • use of products and services offered by the Company (legal basis: Article 6(1)(b) of the GDPR);
  • execution of concluded sales contracts for products and services, including the performance of the concluded contract (legal basis: art. 6 sec. 1 letter „b” GDPR);
  • investigations or defense against potential claims (legal basis: Article 6(1)(f) GDPR);
  • for marketing purposes – provided that the Customer gives separate consent (legal basis: art. 6 sec. 1 letter „a” GDPR);
  • for the purpose of sending the Company's commercial information electronically – provided that the Customer gives separate consent (legal basis: art. 6(1)(a) of the GDPR);

Providing data is voluntary, but necessary to achieve the above goals.

Stalko will transfer your personal data to other recipients who have been entrusted with the processing of personal data on behalf of and for Stalko. Entities entrusted with the processing of your personal data may process your personal data in accordance with GDPR in a third country. These entities may also use further entities to process your personal data, which will process them in a third country.

The categories of recipients to whom Stalko has entrusted the processing of personal data also include: its subcontractors, suppliers, and external entities cooperating with Stalko. Your personal data may therefore also be transferred to and processed in a country outside the European Economic Area (EEA). Each transfer of personal data is carried out in accordance with applicable law. If data is transferred outside the EEA, Stalko applies an appropriate level of data protection.

Your data may be transferred to third countries and international organizations if entities based in those countries have implemented appropriate safeguards for personal data processing.

Stalko will not share Your personal data with other recipients, apart from those to whom the processing of personal data has been entrusted on behalf and for the benefit of Stalko, unless the disclosure is required by law, or the disclosure results from the relationship between You and Stalko.

How long will we process your data?

Data will be stored for the duration of the Client's business relationship with Stalko, but no longer than 3 years from the termination of that relationship, subject to the condition that it will not be stored longer than the moment the Client objects to such processing. When consent is the basis for processing, data will be stored until consent is withdrawn.

Customer data is not and will not be subject to profiling.

The processing of Customer's personal data for marketing purposes is based on separate consent.

The processing of personal data for the purpose of sending commercial information electronically is based on separate consent.

What are your rights?

You have the right to:

  • access to their personal data and to receive a copy of the personal data being processed;
  • correction of your incorrect data;
  • requests for erasure of data (right to be forgotten) in cases where the circumstances referred to in Article 17 GDPR occur;
  • requests to restrict the processing of data in cases specified in Article 18 of the GDPR;
  • objecting to the processing of data in cases indicated in Article 21 GDPR;
  • transfer of data provided, processed automatically.

 

If you believe your personal data is being processed unlawfully, you may lodge a complaint with the supervisory authority (UODO, ul. Stawki 2, Warsaw).

For what purpose and on what basis do we process your data?

Your personal data will be processed in connection with sending you the Newsletter electronically. The legal basis for processing your personal data for the purpose of receiving the Newsletter is your prior consent to marketing communication and Art. 6(1)(b) of the REGULATION OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL (EU) 2016/679 of April 27, 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation), hereinafter referred to as GDPR. Providing personal data is not obligatory, but it is necessary for you to receive the Newsletter from us as part of an electronic services agreement.

Stalko will transfer your personal data to other recipients who have been entrusted with the processing of personal data on behalf of and for Stalko. The entities to whom your personal data processing has been entrusted belong, in particular, to the category of infrastructure solution providers and may process your personal data in accordance with GDPR in a third country. These entities may also use further entities for the processing of your personal data, which will process it in a third country.

Categories of recipients to whom Stalko has entrusted the processing of personal data also include: its subcontractors, suppliers, and external entities cooperating with Stalko. Your personal data may therefore also be transferred to a country outside the European Economic Area (EEA) and processed there. Every personal data transfer operation is performed in accordance with applicable law.

Your data may be transferred to third countries and international organizations, provided that entities based in those countries have implemented appropriate safeguards for the personal data being processed.

Stalko will not share your personal data with other recipients, except for those to whom personal data processing has been entrusted on behalf of and for Stalko, unless Stalko is obliged to share the data based on legal provisions, or sharing results from the relationship between you and Stalko.

How long will we process your data?

Your personal data will be processed solely for the duration of the electronic services agreement concerning the sending of the Newsletter. The agreement binds you and Stalko until you unsubscribe from the mailing list for receiving the Newsletter.

What are your rights?

You have the right to:

  • access to their personal data and to receive a copy of the personal data being processed;
  • correction of your incorrect data;
  • requests for erasure of data (right to be forgotten) in cases where the circumstances referred to in Article 17 GDPR occur;
  • requests to restrict the processing of data in cases specified in Article 18 of the GDPR;
  • objecting to the processing of data in cases indicated in Article 21 GDPR;
  • transfer of data provided, processed automatically.

Pursuant to Article 13(1) and (2) of the Regulation of the European Parliament and of the Council (EU) 2016/679 of April 27, 2016, on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) (OJ EU L 2016.119.1) (hereinafter referred to as the „GDPR”), I inform you that:

Stalko will process your personal data for the purpose of:

  1. conducting the recruitment process, based on the employer's authorization resulting from Art. 22¹. The basis for processing the above-mentioned personal data is a legal obligation (legal basis: Art. 6(1)(c) GDPR in conjunction with labor law provisions),
  2. to conduct the recruitment process, based on your consent to process your personal data, i.e. personal data other than that indicated in the above point, provided in your CV, application form, cover letter, and other documents. The legal basis for processing is the aforementioned consent (legal basis: art. 6(1)(a) GDPR),
  3. fulfillment of the administrator's legitimate interest in data obtained from you during the recruitment process related to verifying your skills and abilities needed for the position specified in the advertisement. The legal basis for processing this data is our legitimate interest (legal basis: art. 6(1)(f) of GDPR),
  4. implementation of the legitimate interests of the controller in the event of a legal need to demonstrate facts, to demonstrate the fulfillment of obligations (legal basis: art. 6(1)(f) of the GDPR),
  5. for carrying out future recruitment processes, based on your consent to process personal data provided in your CV, application form, cover letter, and other documents. The legal basis for processing is this consent (legal basis: Article 6(1)(a) of the GDPR).

 

Stalko will transfer your personal data to other recipients who have been entrusted with the processing of personal data on behalf and for the benefit of Stalko. Entities entrusted with the processing of your personal data may process your personal data in accordance with GDPR, in a third country.

 

These entities may also use further entities for the processing of your personal data, which will process it in a third country. The categories of recipients to whom the processing of personal data has been entrusted also include: its subcontractors, suppliers, and external entities cooperating with Stalko. Every personal data transfer operation is carried out in accordance with applicable law. If data is transferred outside the EEA, Stalko applies an appropriate level of data protection. Your data may be transferred to third countries and international organizations, provided that entities based in these countries have implemented appropriate security measures for personal data processed.

Providing personal data such as name, date of birth, place of residence, education, and employment history is a requirement for participating in the recruitment process. Providing personal data in other areas is voluntary.

Stalko will not share your personal data with any recipients other than those to whom personal data processing has been entrusted on behalf of and for Stalko, unless disclosure is required by law, or disclosure results from the relationship between you and Stalko.

We inform you that we do not make decisions in an automated manner, including through profiling.

How long will we process your data?

  • To the extent indicated in points 1. A, B, C, your data will be stored for the period necessary to conduct this recruitment,
  • In the scope indicated in point 1 D, your data will be stored for the period of limitation of claims resulting from legal provisions, as well as for the time during which provisions require us to store data.,
  • In the scope indicated in point 1 E, your personal data will be stored for a period of 12 months from the date of consent.

 

What are your rights?

You have the right to:

  • access to their personal data and to receive a copy of the personal data being processed;
  • correction of your incorrect data;
  • requests for erasure of data (right to be forgotten) in cases where the circumstances referred to in Article 17 GDPR occur;
  • withdrawal of consent for the processing of personal data.

Withdrawing consent does not affect the lawfulness of processing carried out based on your consent prior to its withdrawal. You can send a statement of withdrawal of consent for personal data processing to the company address provided below.

  • requests to restrict the processing of data in cases specified in Article 18 of the GDPR;
  • objecting to the processing of data in cases indicated in Article 21 GDPR;
  • transfer of data provided, processed automatically.

To ensure a proper recruitment process, please include the following consent clauses in your CV:  

 

  • I consent to the processing of my personal data, other than that required by law and indicated in my CV, by STALKO LIMITED LIABILITY PARTNERSHIP sp.k. for the purposes of this recruitment process.
