RODO INFORMATION OBLIGATION

Ladies and Gentlemen,

The privacy of our customers is extremely important and we want you to feel comfortable with the security of your personal data as well.

In accordance with Art. 13(1) 1 and 2 of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016. on the protection of individuals with regard to the processing of personal data and on the free movement of such data and the repeal of Directive 95/46/EC (General Data Protection Regulation) (OJ.EU.L.2016.119.1) (hereinafter “RODO”), I inform you that:

 

The administrator of your personal data is STALKO Limited Company, Solec 24/253, 00-403 Warsaw, NIP: 9482603545, REGON: 361379132, KRS: 0000836475.

Your personal data are processed in accordance with the Regulation and Polish law for the purpose of:

  • the performance of a possible contract (legal basis: art. 6(1)(b) of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016. on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation), hereinafter referred to as “RODO”);
  • the use of the products and services offered by the Company (legal basis: Article 6(1)(b) of the RODO);
  • the performance of concluded contracts for the sale of products and services, including the performance of the concluded contract (legal basis: Article 6(1)(b) RODO);
  • to assert or defend against possible claims (legal basis: Article 6(1)(f) RODO);
  • w celach marketingowych – w przypadku wyrażenia odrębnej zgody przez Klienta (podstawa prawna: art. 6 ust. 1 lit. „a” RODO);
  • for the purposes of sending the Company’s commercial information by electronic means – in the event of separate consent by the Customer (legal basis: Article 6(1)(a) RODO);

The provision of data is voluntary, but necessary for the above purposes.

Hitze will transfer your personal data to other recipients entrusted with the processing of personal data on behalf of and for Hitze. Entities entrusted with the processing of your personal data may process your personal data under the RODO, in a third country. These entities may also use further entities to process your personal data in a third country.

The categories of recipients to whom Hitze has entrusted the processing of personal data also include: its subcontractors, suppliers and external collaborators of Hitze Your personal data may therefore also be transferred to a country outside the European Economic Area (EEA) and be processed there. Any transfer of personal data is carried out in accordance with applicable law. If data is transferred outside the EEA, Hitze applies an appropriate level of data protection.

Your data may be transferred to third countries and international organisations insofar as the entities established in these countries have implemented appropriate safeguards for the processing of personal data.

Hitze will not share your personal data with any recipients other than those entrusted with the processing of personal data on behalf of and for Hitze, unless the sharing is required by law, or the sharing is due to the relationship between you and Hitze.

How long will we process your data?

The data will be stored for the duration of the Customer’s business relationship with Hitze and no later than for a period of 3 years after the termination of that relationship, provided, however, that no later than until the Customer objects to such processing. When processing is based on consent, until it is withdrawn.

Customer data is not and will not be subject to profiling.

Processing of the customer’s personal data for marketing purposes takes place on the basis of separate consent.

The processing of personal data for the purpose of sending commercial information by e-mail is carried out on the basis of separate consent.

What rights do you have?

You have the right to :

  • access to their personal data and receive a copy of the personal data being processed;
  • to rectify his or her incorrect data;
  • request the erasure of data (right to be forgotten) in the event that the circumstances provided for in Art. 17 RODO;
  • to request the restriction of data processing in the cases referred to in Art. 18 RODO;
  • to object to the processing of data in the cases referred to in Art. 21 RODO;
  • portability of the data provided, processed by automated means.

 

If you believe that your personal data is being processed unlawfully, you may lodge a complaint with the supervisory authority (UODO, ul. Stawki 2, Warsaw).

For what purpose and on what basis do we process your data?

Your personal data will be processed in connection with sending the Newsletter to you electronically. The legal basis for the processing of your personal data for the purpose of receiving the Newsletter is your previously given consent to the marketing communication and Art. 6(1). 1(b) of REGULATION (EU) 2016/679 OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL of 27 April 2016. on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation), hereinafter referred to as RODO. The provision of personal data is not mandatory, but is necessary in order for you to be able to receive the Newsletter from us within the framework of an agreement for the provision of electronic services.

Hitze will pass on your personal data to other recipients entrusted with the processing of personal data on behalf of and for Hitze. Entities entrusted with the processing of your personal data fall in particular into the category of infrastructure solution providers and may process your personal data in accordance with the RODO, in a third country. These entities may also use further entities to process your personal data in a third country.

The categories of recipients to whom Hitze has entrusted the processing of personal data also include: its subcontractors, suppliers and external entities cooperating with Hitze. Your personal data may therefore also be transferred to a country outside the European Economic Area (EEA) and processed there. The transfer of personal data is carried out in accordance with the applicable legislation.

Your data may be transferred to third countries and international organisations provided that the entities based in these countries have implemented appropriate safeguards for the personal data processed.

Hitze will not share your personal data with any other recipients other than those entrusted with the processing of personal data on behalf of and for Hitze, unless the sharing is required by law or the sharing arises from the relationship between you and Hitze.

How long will we process your data?

Your personal data will only be processed for the duration of the contract for the provision of electronic services concerning the dispatch of the Newsletter. The agreement links you and Hitze until you unsubscribe from the mailing list, in accordance to to receive the Newsletter.

What rights do you have?

You are entitled to:

  • access to their personal data and receive a copy of the personal data being processed;
  • to rectify his or her incorrect data;
  • request the erasure of data (right to be forgotten) in the event that the circumstances provided for in Art. 17 RODO;
  • to request the restriction of data processing in the cases referred to in Art. 18 RODO;
  • to object to the processing of data in the cases referred to in Art. 21 RODO;

In accordance with Art. 13(1) 1 and 2 of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016. On the protection of individuals with regard to the processing of personal data and on the free movement of such data and the repeal of Directive 95/46/EC (General Data Protection Regulation) (OJ.EU.L.2016.119.1) (hereinafter “RODO”), I inform you that:

Hitze will process your personal data for:

  1. To carry out the recruitment process, on the basis of the employer’s entitlement under Article 22¹.The basis for the processing of the above personal data is a legal obligation (legal basis: Article 6(1)(c) RODO in connection with employment law),
  2. to carry out the recruitment process, on the basis of your consent to the processing of your personal data, i.e. personal data other than that indicated in the point above provided in the CV, form, cover letter and other documents. The basis of the processing is the aforementioned consent (legal basis: Article 6(1)(a) RODO),
  3. to pursue the controller’s legitimate interest in the data collected from you during the recruitment process in relation to verifying your skills and abilities needed for the position advertised. The basis for processing this data is our legitimate interest (legal basis: Article 6(1)(f) RODO),
  4. the fulfilment of the legitimate interest of the controller in the event of a legal need to prove facts, to demonstrate the fulfilment of obligations (legal basis: Article 6(1)(f) RODO),
  5. to carry out future recruitment processes, based on your consent to the processing of personal data provided in your CV, form, cover letter and other documents. The basis for the processing is this consent (legal basis: Article 6(1)(a) RODO).

 

Hitze will transfer your personal data to other recipients entrusted with the processing of personal data on behalf of and for the benefit of Hitze Entities entrusted with the processing of your personal data may process your personal data under the RODO, in a third country.

 

These entities may also use third parties to process your personal data in a third country. The provision of personal data concerning name, date of birth, place of residence, education and previous employment history is a condition for taking part in the respective recruitment process. Otherwise, the provision of personal data is voluntary.

Hitze will not share your personal data with any recipients other than those entrusted with the processing of personal data on behalf of and for Hitze, unless the sharing is required by law or the sharing is due to the relationship between you and Hitze.

Please be informed that we do not make decisions by automated means, including profiling.

How long will we process your data?

  • To the extent indicated in para. 1. A, B, C Your data will be kept for the time necessary to carry out this recruitment,
  • To the extent indicated in point. 1 D Your data will be retained for the period of the statute of limitations for claims under the law, and for the time that the law requires us to keep the data,
  • W zakresie wskazanym w pkt. 1 E Your personal data will be stored for a period of 12 months from the date of your consent.

 

What rights do you have?

You have the right to:

  • access to their personal data and receive a copy of the personal data processed;
  • to rectify his or her incorrect data;
  • request the erasure of data (right to be forgotten) in the event that the circumstances provided for in Art. 17 RODO;
  • withdraw consent to the processing of personal data.

The withdrawal of consent does not affect the lawfulness of the processing carried out on the basis of your consent before its withdrawal. A declaration of withdrawal of consent to the processing of personal data can be sent to the company address below.

  • to request the restriction of data processing in the cases referred to in Art. 18 RODO;
  • to object to the processing of data in the cases referred to in Art. 21 RODO;
  • portability of the data provided, processed by automated means.

In order to carry out a proper recruitment process, we strongly request that you include a consent clause in your CV:

  • I consent to the processing of my personal data other than those required by law and indicated in my CV by STALKO Limited Company for the purposes of this recruitment process.
  • I agree to the processing of my personal data by STALKO Limited Company contained in the CV – required if the data provided include special categories of data referred to in Art. 9(2). 1 RODO.
  • I agree to the processing of my personal data by STALKO Limited Company for future recruitment processes for a period of 9 months. – Required if you want us to leave your CV for future recruitment.
